Terms and Conditions

§ 1 Scope

These Terms and Conditions (hereinafter “T&C”) apply to all contracts concluded between Philipp Schmid, Steinenberg 10, 88339 Bad Waldsee (hereinafter “Seller”) and the customer (hereinafter “Buyer”) via the online shop stickymicky.com.

The version of the T&C valid at the time of the order shall apply. Deviating terms of the Buyer are not accepted unless the Seller expressly agrees to them in writing.

§ 2 Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to submit an offer (invitatio ad offerendum).

By clicking the “Place order” button, you place a binding order for the goods in the shopping cart. Confirmation of receipt of the order follows immediately after placing the order via email.

The purchase contract is concluded when we accept your order by sending an order confirmation email or by shipping the goods.

§ 3 Prices and shipping costs

All stated prices are final prices and include the applicable value added tax. Any additional shipping costs are clearly indicated before completing the order.

Shipping within Germany is free for orders of €30.00 or more. For orders below €30.00, shipping costs of €4.99 apply. Shipping costs to other EU countries are displayed at checkout.

§ 4 Delivery

Delivery is made to the address provided by the Buyer. The delivery time is usually 2–3 business days within Germany, 5–7 business days within the EU.

If the ordered goods are not available, the Seller reserves the right not to provide the service. In this case, the Buyer will be informed immediately and any payments already made will be refunded.

§ 5 Payment terms

The purchase price is due immediately upon ordering. Payment is made via the payment methods offered in the shop (credit card, PayPal, Apple Pay, Klarna).

Payment processing is handled by the payment service provider Stripe Inc. The terms of use and privacy policy of Stripe also apply.

§ 6 Right of withdrawal

Consumers have a 14-day right of withdrawal. You may revoke your contractual declaration within 14 days without giving reasons in text form (e.g. letter, email) or by returning the goods. The period begins after receipt of the goods.

To exercise the right of withdrawal, it is sufficient to send the withdrawal or the goods in time. The withdrawal should be addressed to: Philipp Schmid, Steinenberg 10, 88339 Bad Waldsee or by email to [email protected].

The right of withdrawal does not apply to contracts for the delivery of goods made to customer specifications (e.g. individually designed AI stickers), unless the goods are defective.

§ 7 Warranty

Statutory warranty rights apply. In the event of defects, you first have the right to subsequent performance (repair or replacement delivery).

The warranty period is two years from delivery of the goods. Obvious defects must be reported within two weeks of receipt of the goods.

§ 8 Liability

The Seller is liable without limitation for intent and gross negligence. In the case of slight negligence, the Seller is only liable for breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable, contract-typical damage.

The above limitation of liability does not apply to injury to life, body, or health, or to claims under the Product Liability Act.

§ 9 Data protection

We collect and process personal data only in accordance with applicable data protection laws. For details, please refer to our Privacy Policy.

§ 10 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as mandatory provisions of the law of the state in which the consumer has their habitual residence do not preclude it.

Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by the relevant statutory provision.
